  • Once a firm receives the Employer Retention Credit from the I.R.S. they need to amended their Corporate and Personal returns for the reduction in wages that the retention credit is given on.   Call us to set up an appointment to amend your returns.  The credit itself is non-taxable. The interest paid on the credit is however taxable.

  • There is a new law called the Beneficial Ownership Information Reporting Rule, which goes into effect January 1, 2024.   A federal court halts implementation of BOI requirement on Small Businesses Under the Corporate Transparency Act.  BREAKING: Federal Court Halts Implementation of Beneficial Ownership Information Reporting (BOI) Requirements on Small Businesses Under the Corporate Transparency Act
  • A federal court in Texas halted the implementation of the Corporate Transparency Act’s (CTA) Beneficial Ownership Information reporting requirements (BOI). Holding that the CTA is likely unconstitutional, the court issued a preliminary injunction barring the government from enforcing the CTA and its reporting requirements against anyone.
  • Why it matters: Prior to the ruling, small businesses that met certain criteria would have had to file reports with the Department of the Treasury by January 1, 2025, or risk fines and criminal penalties.‌
  • Looking ahead: The preliminary relief will remain in effect until the conclusion of legal proceedings, at which point the court may enter a permanent injunction. In the meantime, the government will likely appeal the preliminary injunction. As of Dec. 27, the merits of the case have yet to be heard; briefs are now due in February, and the case is calendared for oral arguments on March 25, 2025, according to the NSBA.  Looks like we will make it through tax season!
  • Bottom line: Unless and until an appellate court overrules or narrows the injunction, no businesses are obligated to comply with the reporting requirements.
